1. Who we are

Below, “we” and “us” mean the company operating the WAYCUP brand; “you” means the business we are dealing with. Our full company details are stated in every quotation and invoice.

2. This website is information, not an offer

You cannot buy anything on this website. There is no shopping basket, no payment and no account. The form sends us a request to call you back — nothing more.

Prices, lead times, minimum quantities, dimensions and specifications shown here are indicative. They are not a binding offer within the meaning of § 43a of the Slovak Civil Code, and sending the form does not create a contract. A contract arises only when we confirm your order in writing, which includes email.

3. Who we work with

We sell business to business: to entrepreneurs and legal persons acting in the course of their trade. These terms are written on that basis, and the Slovak and EU rules on consumer distance selling — including the fourteen-day right of withdrawal — do not apply to them.

If you are buying as a private individual rather than for a business, say so before you order. We will either decline or deal with you under separate consumer terms. We will not quietly apply business terms to a consumer.

4. From enquiry to confirmed order

  1. You tell us what you need, through the form, by phone, on WhatsApp or by email.
  2. We send a written quotation: specification, quantity, unit price, total, VAT treatment, and the earliest realistic production and delivery window.
  3. A quotation is valid for the period stated in it. Paperboard and freight prices move, so after that we may need to requote.
  4. You accept in writing. We confirm in writing. The contract exists from our confirmation.
  5. For custom printing, two more things must happen before production starts: you approve the print proof (clause 5) and your payment is confirmed (clause 10).

What we do with it

We adapt your artwork to our production dies at no charge and include up to three revision rounds to reach a production-ready layout. That covers technical adaptation — bleeds, seams, the rim area, trapping. It is not a design service: we do not create a logo or a layout from scratch, and redrawing artwork that does not meet the specification above may be quoted separately.

Your warranty about the artwork

By sending us artwork you confirm that you own it or are licensed to use it for this purpose — including logos, trademarks, photographs, illustrations and fonts — and that printing it does not infringe anyone’s rights.

If a third party makes a claim against us because of artwork you supplied, you will cover our reasonable costs and any damages awarded, provided we tell you about the claim promptly, let you take over the defence, and do not settle it without your agreement.

We may refuse artwork that is unlawful, or that we have reasonable grounds to believe infringes someone’s rights, and we will tell you why.

Proof approval is the point of no return

We send you a visualisation and then a final flat print proof. Production starts only after you approve that proof in writing. The approved proof is the reference against which the finished product is judged.

After approval, the layout is on the printing die. Changes mean a new die and a new run: we will tell you the cost and the new schedule, and you decide. Please check spelling, the ingredient and legal text, barcodes, QR codes and contact details on the proof — those are yours to verify, and a mistake we reproduced faithfully from an approved proof is not a defect.

6. Colour

We print on paperboard. Paperboard is absorbent and slightly off-white, and the same file will look different on a screen, on an office printer, on a coated flyer and on a cup. Colour is controlled against the approved digital proof, within the tolerance customary in the industry for printing on paperboard.

A difference from a screen, from a Pantone swatch, or from a print made on a different substrate or by a different supplier is not a defect. If exact colour matching matters to you, ask for a physical sample of your own run before full production and we will quote for it.

Small variations between production batches are normal for this material and are not a defect either.

7. Quantity

Set-up and make-ready mean the finished quantity of a printed run is never exactly the ordered figure. A small variation above or below the ordered quantity is customary in printing. The tolerance that applies to your run is stated in the quotation, and we invoice the quantity actually delivered. If you need a guaranteed minimum, tell us before production and we will plan the run for it.

8. Lead times

Manufacturing and delivery cycles for custom printing start from 21 business days for runs between 1,500 and 5,000 pcs in standard CMYK with water-based varnish.

The count starts on the later of two events: your written approval of the print proof, and confirmation of your payment. The final schedule is calculated for each order and depends on the quantity, the cup volume, the complexity of the printing, any premium finish and the transport route. Standard, unprinted products ship from stock and are quoted separately.

A lead time is an estimate unless we have confirmed a specific date in writing for your order. We will tell you as soon as we know of a delay, and we are not liable for a delay caused by something outside our control (clause 16).

9. Samples

A complimentary sample kit is available on request so you can assess the paperboard, the lid fit and the quality of the printing. Samples show material and construction. They are not a colour commitment for your own run, and they do not bind us to a price.

10. Prices, VAT and payment

Late payment

If an invoice is not paid on time we may charge statutory default interest under Slovak law and the fixed sum for recovery costs provided for in § 369c of the Slovak Commercial Code, which implements Directive 2011/7/EU on combating late payment. We may also hold back further deliveries until the account is settled. We will contact you before doing either.

11. Delivery, risk and checking the goods

We deliver across Slovakia through our own logistics network. Delivery outside Slovakia is quoted individually. Risk of loss or damage passes to you when the goods are handed over to you or to a carrier you nominated.

Check the shipment at handover. Count the cartons and look for transport damage. Anything visible — a short delivery, a crushed or wet carton — must be written on the delivery note at the moment of handover, because afterwards it cannot be shown whether it happened before or after the handover.

Hidden defects — something that only shows when a carton is opened — must be reported without undue delay after you discover them, as § 428 of the Slovak Commercial Code requires. The sooner you tell us, the easier it is to trace the batch while the evidence still exists.

12. Complaints

Send a complaint to waycup.sk@gmail.com with the invoice or delivery note number, the quantity affected, a description of the problem, and photographs. Keep the affected goods and their packaging until the complaint is settled — we may need to inspect them or have them returned.

We confirm that we have received a complaint and tell you how and by when we will resolve it. Where a complaint is justified we will, in consultation with you, replace the affected goods, reproduce the run, or issue a credit note for the affected quantity.

13. Returns of standard goods

Unprinted standard products may be returned only by prior agreement, and only if they are unopened, undamaged and in their original cartons, with the return freight at your cost. Custom-printed goods cannot be returned: they carry your branding and have no other buyer.

14. Ownership

The goods remain our property until the invoice for them has been paid in full. You may still resell them in the ordinary course of your business before then.

15. Liability

We are liable for damage caused by a breach of our obligations under §§ 373 and following of the Slovak Commercial Code. As § 379 provides, compensation covers the actual damage and lost profit, but not damage that we could not have foreseen as a possible consequence of the breach when the contract was concluded.

Some results are not a breach in the first place: a print that faithfully reproduces artwork you approved, colour within the tolerance described in clause 6, and a quantity within the tolerance stated in your quotation (clause 7).

16. Circumstances outside our control

Neither side is liable for failing to perform because of a circumstance excluding liability under § 374 of the Slovak Commercial Code — something it could not reasonably control or avoid, including a failure of paperboard or ink supply, an energy or transport disruption, fire, flood, strike, war, or a public authority’s measure. We will tell you promptly, give a realistic new date, and if the obstacle lasts more than 60 days either side may withdraw from the affected order. In that case we return any prepayment for goods not yet produced, less work already demonstrably carried out on your specific run.

17. Confidentiality

We treat unreleased artwork, your designs and your commercial terms as confidential, and we do not show them to anyone outside the people who need them to produce your order.

Finished work may appear in our production portfolio. If you would rather it did not, tell us when you place the order and we will keep it out.

18. Intellectual property on this website

The texts, photographs, layout and code of this website belong to us. The brands and logos shown in the portfolio belong to their owners and appear as examples of work we produced. Neither may be copied or reused without permission.

19. The website itself

We keep the information here as accurate as we can, but specifications, availability and prices change. We give no warranty that the website is free of errors or always available, and we may change or remove any part of it. Nothing on it replaces a written quotation.

20. Governing law and jurisdiction

These terms and any contract made under them are governed by the law of the Slovak Republic, in particular the Commercial Code (513/1991 Coll.). The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Disputes will be settled by the courts of the Slovak Republic having jurisdiction over our registered seat. We would much rather settle a disagreement by talking to you first — please call before anything else.

21. Changes to these terms

This is version 1.0, in force from 8 November 2026.

We may update these terms. The version in force on the day we confirm your order governs that order, and a later change never applies retroactively to work already confirmed. Earlier versions are available on request from waycup.sk@gmail.com.
